BIRTH REGISTRATION

Live birth is the complete expulsion or extraction of a product of conception from its mother, irrespective of the duration of pregnancy, which after such separation, breathes or shows any other evidence of life, such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, whether or not the umbilical cord has been cut off or the placenta is still attached; each product of such birth is considered alive. A fetus with intra-uterine life of seven(7) months or more and born alive at the time it was completely delivered from the maternal womb but died later shall be considered as live birth and shall be registered in the Register of Births.

Birth of the child shall be registered in the Office of the City/Municipal Registrar where the birth occurred except in the following cases:

  • When the child is born aboard a vehicle, vessel or airplane while in transit within the Philippine territory and the exact place of birth cannot be ascertained, the birth shall be recorded in the civil register of the mother's destination or the city or municipality where the mother habitually resides; (Rule 19a of Adm. Order No. 1,s.1993)
  • When the child is born aboard a vessel or airplane   en route to the Philippines and the exact place of birth cannot be ascertained, the birth shall be recorded in the civil register of the city or municipality where the mother habitually resides if she is a resident of the Philippines, and if either the father or mother or both parents are citizens of the Philippines, the birth shall be recorded in the city or municipality where the mother habitually resides in the Philippines. If the parents are both foreigners but not residents of the Philippines, the birth may be recorded in the civil register of Manila, if they so desire. (Rule 19b of Adm. Order No.1, 2. 1993); and
  • When the child, whose mother or father or both parents are citizens of the Philippines, is born aboard a vessel or airplane en route to another country from the Philippines, or from any country, the birth shall be recorded in the Philippine Foreign Service Establishment of the country of the mother's destination. (Rule 19c of Adm. Order No. 1, s.1993)
In any case under this Rule, the place of birth shall be entered in the civil register as follows:
  • If birth occurred aboard a vehicle, indicate in the civil register as the place of birth, the name of the vehicle, route, plate number and other necessary description of the vehicle;
  • If birth occurred aboard a vessel, indicate in the civil register as the place of birth, the name of the vessel, route, voyage number, registry number and other necessary description of the vessel; and
  • If the birth occurred aboard an airplane, indicate in the civil register as the place of birth, the name of the airplane, route, flight number and other necessary description of the airplane

IN CASE OF DELAYED REGISTRATION OF BIRTH

If a person is less than eighteen (18) years old, the following shall be required:
Four (4) copies of the Certificate of Live Birth duly accomplished and signed by the proper parties;

Accomplished Affidavit for delayed registration at the back of the Certificate of Live Birth by the father, mother or guardian, declaring therein, among other things, the following:

  • name of the child;
  • date and place of birth;
  • name of the father if the child is illegitimate and has been acknowledged by him;
  • if legitimate, the date and place of marriage of parents; and
  • reason for not registering the birth within thirty(30) days after the date of birth.

In case the party seeking late registration of the birth of an illegitimate child is not the mother, the party shall, in addition to the foregoing facts, declare in a sworn statement the present whereabouts of the mother.

Any two (2) of the following documentary evidences which may show the name of the child, date and place of birth, and name of mother (and name of father, if the child has been acknowledged or legitimate child);

  • baptismal certificate;
  • school records(nursery,kindergarten or preparatory)
  • income tax return of parent/s;
  • insurance policy;
  • medical records; and others, such as barangay captain's certification

Affidavit of two disinterested persons who might have witnessed or known the birth of the child.

If the person is eighteen (18) years old and above, he shall apply for late registration of his birth and the requirements shall be:

All the requirements for a child who is less than Eighteen(18) years old; and Certificate of Marriage, if married.

OUT-OF-TOWN REPORTING OF BIRTH

OUT-OF-TOWN reporting of birth occurs when the Certificate of Live Birth is presented to the Civil Registrar of a city or municipality which is not the place of birth, not for registration but to be forwarded to the Civil Registrar of the city or municipality where the birth occurred and where it should be registered.

Requirements to be complied with:

The party who is applying for out-of-town reporting of birth shall execute an Affidavit declaring therein, among other things, the facts of birth and the reasons why said birth was not recorded in the civil register of the city or municipality where it occurred.                                 

The Affidavit which must be attested by at least two (2) witnesses, shall serve as an application for registration and shall be submitted to the civil registrar together with four (4) copies of the Certificate of Live Birth .

If the application is for delayed registration of birth, the requirements under the rules governing delayed registration shall be complied with.

Marriage is a special contract of permanent union between a man and a woman entered into in accordance with law for the establishment of a conjugal and family life . it is the foundation of the family and an inviolable institution whose nature, consequences and incidents are governed by law.

Registration of Application for Marriage License.

Registration of the Application for marriage license shall be filed by the contracting parties to the office of the City/Municipal Civil Registrar either of their residence complying the following:

A. Upon submission of the application, which specify the following data such as;

  1. Full name of the contracting parties;
  2. Place of Birth;
  3. Age and date of Birth;
  4. Civil status;
  5. If previously married how,when and where the previous marriage was dissolved or annulled;
  6. Present residence and citizenship;
  7. Degree of relationship of the contracting parties;
  8. Full name, residence and citizenship of the father;
  9. Full name, residence and citizenship of the mother and
  10. Full name, residence and relationship of the guardian or person having in charge, in case the contracting party has neither father nor mother and is under the age of twenty-five years old.

B. Upon submission and complying the following:

  1. Presentation of the Original Birth Certificate, in default thereof, the baptismal certificate of any document showing proof of age and in case the applicant is a widow or widower the death certificate of deceased spouse of the contracting party;
  2. parental Consent or parental Advice of the parents,guardian, or legal person authorized by law, in case of a foreigner applicant the Legal Capacity is required;
  3. Pre Marriage Counseling Seminar Certificate;

C. Marriage License will be issued after ten (10) days posting and valid for One hundred twenty (120) days and can be used anywhere in the Philippines.

Registration of Certificate of Marriage ( COM)

  1. Submit four(4) copies of Certificate of Marriage after the ceremony, duly signed by the contracting parties and at least two (2) witnesses and the Solemnizing Officer to the Civil Registrar Office where the place of the Ceremony took place.
  2. In ordinary marriage, the prescribed period of registration of COM is within fifteen (15) days following the solemnization of marriage while special marriage or marriage exempt from marriage license such as: Marriage under Art 29- when there is no means of transportation, Art 28- Articulo Mortis , Art 34- Living together as husband and wife for the period of five years and above without impediment to marry each, and Art 33- Marriage under cultural minorities , the prescribed period to register is thirty (30) days.

Registration of Foundling

Foundling is a deserted or abandoned infant or a child found, with parents, guardian or relatives being unknown or a child committed in an orphanage of charitable or similar institution with unknown facts of birth and parentage.

Registration of foundling in the Office of the City Municipal Civil Registrar where the child was found within thirty (30) days from the date of finding of the child.

Person responsible to register is the finder after a report in the Office of the Barangay Captain where he child was found, or to the police authorities whichever is convenient to the finder. When the report is duly noted, the finder shall commit the child to the Department of Social Welfare and development Office.

Requirements for Registration of Foundling

  1. ccomplishes Certificate of foundling (OCRG Form NO. 101)
  2. Affidavit of the finder stating the facts and circumstances surrounding the finding of the child and the fact that founding has been reported to the Barangay Captain or to the police authority, as the case may be; and
  3. Certification of the barangay captain or police authority regarding the report made by the finder, stating among other things, that no one has reported a missing child whose description maybe the same as the foundling as of the date of certification.

Registration of Court Orders/Decrees

  1. Court orders/decrees issued by the Regional Trial Court (RTC) concerning the status of a person shall be register in the Office by the Local Civil Registrar where the court is functioning within ten (10) days after the decree/order has become final.
  2. It is the duty of the clerk to advise the successful petitioner to have the decree /order registered in the Local Civil Registrar.
  3. The Civil Registry Office where the event of the decree/order was registered shall forward the certified true copy of the decision to the civil registry office where an event affected was originally registered and the latter likewise shall make the proper annotations in the document and in the registry book.

INNOVATIONS OF CIVIL REGISTRATION

1.Presendential Decree 1083- Code of Muslim Personal Laws

These laws enable the Muslim Filipinos to register their birth, death and marriages in accordance with their culture customs and tradition. PD 1083 took effect on February 4, 1977.

  1. Administrative Order No 2, Series of 1993- Implementing Rule and Regulations Governing Registration of Acts and Events concerning civil status of Muslim Filipinos is also a suppletory to Administrative Order No. 1.
  2. Executive Order 157 "Establishing a registration system for Muslim Filipinos"

2. Republic Act 9048

Republic Act 9048 or "An Act Authorizing the City or Municipal Civil Registrar or the Consul General to Correct a Clerical or Typographical Error in entry and /or Change of First name or Nickname in the Civil Register Without Need of a Judicial Order, Amending for this Purpose Articles 376 and 412 of the Civil Code of the Philippines" vests officials dispensing civil registry function with the authority to grant corrections on clerical mistakes or approve changes in a persons first name without a judicial order.

3. Republic Act 83710 (2005) from (IPRA Law,1997)

This act provide the Indigenous people/ Indigenous Cultural Communities to register their vital events in accordance with their culture and traditions thus, recognizes, protects and promote the rights of Indigenous cultural communities/ indigenous peoples, creating a national commission on indigenous people, establishing implementing mechanisms, appropriating funds therefore, and for other purposes.

  1. Administrative Order No 3. Implementing rules and Regulations concerning civil status of IP and CNSP.

4. Republic Act 9255-

"An Act Allowing Illegitimate children to Use the Surname of their father, Amending for this purpose, Article 176 of Executive Order No. 209, otherwise known as the Family Code of the Philippines.

Death is permanent disappearance of all evidence of life at any time after live birth taken place ( postnatal cessation of vital functions without resuscitation).

A fetus with intra-uterine life of seven (7) months or more or born alive at that time it was completely delivered from the maternal womb but died later shall be consider as death and shall be registered in the Register of Deaths.

A fetus with an intra-urine life of less than seven(7) months is not deem born if it dies within twenty four (24) hours after its complete delivery from the mother's womb. For statistical purposes, a Certificate of Death shall be prepared in duplicate and a copy of each shall be forwarded to the Office of the Civil Registrar- General.

As a general rule - where the events occurred there should be recorded.

Exceptions:

In the case of a person dies in a vehicle ,airplane or vessel while in transit within the jurisdiction of the Philippines and the exact place of death cannot be determined , The Certificate of Death shall be issued in the place of burial /cremation an shall be registered in the same place. If the place of burial/cremation is outside the Philippines, the death shall be registered in the Office of Civil Registrar of Manila.

When a citizen of the Philippines and a foreigner residing in the Philippines dies aboard a vessel or airplane en route to the Philippines and the exact place of death cannot be ascertained, the death shall be registered in the place where the person habitually resides before his death. If the foreigner dies is not a resident of the Philippines, his death shall be registered in the Office of the City Civil Registrar of Manila.

When a Philippine citizen dies aboard a vessel of airplane en route to other country
from the Philippines, or other countries , and the exact place of death cannot be ascertained, the death shall be reported in the Philippines Foreign Service Establishments of the country of the destination of the deceased.

The death of a person in a vehicular accident,airplane rash or shipwreck within the jurisdiction of the Philippines and the site of the accident of the place where the victim was found cannot be determined ; The certificate of death shall be registered in the place of burial.

The death of person aboard a vessel in the seas shall be registered in the Office of the Civil registrar of the place it was buried.

if a person was buried or drowned in the high seas, or for any reason, the body was nor recovered, registration shall be made in the civil registry office of the place of the last known address of the deceased, if not resident of the Philippines, it shall be registered in the Civil Registrar of Manila.
and in such case, the following requirements shall be complied with;

  1. Affidavit of the surviving spouse, parent, guardian or nest of kin in the order mentioned stating, among other things, the circumstances surrounding the death and;
  2. the health Officer shall make the annotation "Body Not recovered" in the remarks portion box of the death certificate
